Terms & Conditions

Important — Responsible Service of Alcohol (RSA): Alcohol may only be sold or supplied to persons aged 18 years or over. By placing an order, you warrant that you are at least 18 years of age and, if ordering for another person, that the recipient is at least 18. We may require proof of age on delivery or collection and may refuse service if you appear intoxicated.

These Terms & Conditions ("Terms") govern your access to and use of our website and online store, and any purchase of products or services from us (together, the Services). By using the Services, you agree to be bound by these Terms.


2. Eligibility & RSA compliance

2.1 Age: You must be 18+ to purchase alcohol. We support and comply with all applicable RSA obligations.
2.2 ID checks: We (or our delivery partners) may request acceptable photo ID on delivery/collection. If you or the recipient cannot produce ID, we may refuse delivery/collection and return the goods.
2.3 Secondary supply: It is an offence to obtain alcohol on behalf of a minor.
2.4 Right to refuse service: We may refuse service or delivery where we reasonably suspect intoxication or unlawful supply.

Acceptable ID examples (NSW): current driver licence, passport, NSW Photo Card, Keypass, or other government‑issued proof‑of‑age card.


3. Orders & contract formation

3.1 Placing an order: Your order is an offer to buy. We may accept or reject any order (e.g., due to stock limits, pricing errors, fraud screening).
3.2 Acceptance: A binding contract forms when we issue an order confirmation (email/on‑site) and receive payment.
3.3 Verification: We may contact you to verify details (including age) before accepting your order.
3.4 Personal use: Orders are for personal use only and not for resale unless agreed in writing.


4. Pricing, currency & taxes

4.1 AUD & GST: Prices are in Australian Dollars (AUD) and include GST unless stated otherwise.
4.2 Changes: Prices, promotions and shipping rates may change without notice. The price payable is the price confirmed at checkout.
4.3 Errors: If a pricing/description error is identified, we may cancel the order (with a full refund) or contact you to confirm proceeding at the correct price/details.


5. Product availability, vintages & substitutions

5.1 Availability: Products (including vintages and packaging) are offered subject to availability. Images are illustrative; label/closure/vintage may vary from photography.
5.2 Vintage changes: If the listed vintage is unavailable, we will contact you to offer: (a) the current vintage, (b) a like‑for‑like substitution, or (c) a refund/store credit at your choice. For clearly marked "NV" products, batch variation may occur.
5.3 Rare & collectible items: Minor scuffs, carton wear or label blemishes that do not affect contents are not considered damage. If you require pristine presentation, please contact us before purchase so we can advise on condition and any special‑courier options (fees may apply).
5.4 Natural variation: Wine is an agricultural product; natural variation (e.g., tartrate crystals, bottle variation, cork taint) can occur. See Returns for your rights.


6. Pre‑arrival, pre‑orders & allocations

6.1 Payment & ETA: Payment is taken at checkout to secure allocations. Estimated arrival dates are indicative and may change due to shipping/import delays.
6.2 Unavailability or material delay: If supply becomes unavailable or materially delayed, we will offer a refund or store credit at your election.
6.3 Limits: We may limit quantities per customer to ensure fair access.


7. Payment, fraud prevention & security

7.1 Methods: We accept the payment methods shown at checkout (e.g., major cards, Shop Pay, Apple/Google Pay, PayPal).
7.2 Authorisation: You authorise us to charge your selected payment method for the order total (including shipping/taxes).
7.3 Fraud checks: We and/or our processors may run fraud checks. We may cancel or hold orders pending investigation.


9. Risk & title. Risk & title

9.1 Title passes on full payment.
9.2 Risk passes on delivery to your nominated address (including ATL) or on collection for Click & Collect.


10. Returns, refunds & your rights (ACL)

10.1 Australian Consumer Law (ACL): Our goods and services come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure is not a major failure. Nothing in these Terms limits your ACL rights.
10.2 Faulty, damaged or wrongly described: Contact us promptly with details and photographs (if applicable). We will arrange a refund, repair or replacement in accordance with the ACL.
10.3 Cork taint & bottle variation: For natural faults (e.g., cork taint), notify us within a reasonable time. Assessment may be required; remedies will be provided as required by the ACL.
10.4 Change of mind: At our discretion, we may accept returns of unopened, resaleable items within 14 days of delivery; return shipping is at your cost and a reasonable restocking fee may apply. This does not limit your ACL rights.
10.5 How to claim: Email info@huntershillwineroom.com.au with your order number, description of the issue and photos where relevant. We’ll provide instructions and, if applicable, a prepaid label for ACL claims.


11. Events, tastings & experiences

11.1 Current status: Hunters Hill Wine Room is not currently hosting public events or ticketed tastings. Any future events will be subject to separate published terms and RSA obligations.


12. Gift cards, credits & promotions

12.1 Gift cards: Issued in AUD; redeemable online/in‑store. Unless stated otherwise, gift cards have an expiry of at least 3 years from issue and cannot be exchanged for cash (except as required by law). Keep codes secure.
12.2 Store credits & referral/welcome credits: Credits may carry an expiry (typically 12 months) and are non‑transferable. We may modify, suspend or cancel unused credits where fraud/misuse is suspected.
12.3 Promotions & codes: Subject to published terms (e.g., minimum spend, exclusions, single‑use, stacking rules). We may vary or withdraw offers at any time without affecting accepted orders.


13. Accounts & security

13.1 Single account: You agree to maintain only one customer account unless we approve otherwise; duplicate accounts may be closed and any associated promotional credits cancelled.
13.2 Security: You are responsible for keeping your login secure and for all activity under your account. Notify us of unauthorised use.


14. Website use & intellectual property

14.1 IP ownership: Website content (text, images, logos, graphics, trademarks) is owned by HHWR or our licensors and protected by IP laws.
14.2 Permitted use: You may view/print content for personal use only. You must not copy, distribute, adapt, publish or create derivative works without written consent.
14.3 User content: Reviews/comments must be lawful, accurate and non‑infringing. We may moderate/remove content at our discretion.


15. Prohibited uses

You must not use the Services: (a) for any unlawful purpose; (b) to violate any laws or regulations; (c) to infringe IP or privacy rights; (d) to post or transmit defamatory, abusive, obscene or otherwise objectionable material; (e) to upload malware; (f) to harvest personal data; (g) to spam, phish or scrape; (h) to interfere with security features or site operation.


16. Third‑party services & links

Our site may integrate third‑party services (e.g., payment gateways, shipping tools) and link to third‑party sites. Their terms and privacy policies apply to your use of those services. We are not responsible for third‑party content or practices.


18. Liability & indemnity. Liability & indemnity

18.1 No exclusion of ACL: Nothing in these Terms excludes, restricts or modifies any non‑excludable rights under the ACL.
18.2 Limitation: Subject to the ACL and to the maximum extent permitted by law, our aggregate liability for loss or damage arising from the Services is limited to the amount paid for the order giving rise to the claim. We are not liable for indirect or consequential loss (e.g., loss of profits or opportunity) except where not permitted by law.
18.3 Indemnity: You indemnify us against losses arising from your breach of these Terms or unlawful use of the Services, except to the extent caused by our negligence, fraud or wilful misconduct.


19. Governing law & severability

19.1 Law: These Terms are governed by the laws of New South Wales, Australia, and subject to the jurisdiction of its courts.
19.2 Severability: If any provision is unenforceable, it will be severed and the remainder will continue in full force.
19.3 No waiver: Failure to enforce a right does not constitute a waiver.


20. Changes to these Terms

We may update these Terms from time to time by posting the revised version on our website. The updated Terms take effect when posted and apply to future orders. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
